Court Denies Florida’s Request for Suspension of Health Worker Vaccination Requirement
A split federal appeals court decided Sunday to deny Florida’s attempt to halt a Biden administration mandate requiring health-care workers to be inoculated with the COVID-19 vaccine.
The 11th U.S. Circuit Court of Appeals decided 2-1 to deny a motion by Florida Attorney General Ashley Moody's request for an injunction against the Biden administration's mandate.
The decision stated that Florida “failed to make the requisite showing for an injunction pending appeal.” Judges Robin Rosenbaum and Jill Pryor comprised the majority and Judge Barbara Lagoa dissented. The one-page statement articulated that more complete opinions would be published in the future.
However, Sunday’s decision did not amount to a win for Biden as the decision also restricts the White House from moving ahead with the health-care worker vaccination requirement Monday, as initially determined as a result of a nationwide preliminary injunction against the administration issues last week by a Louisiana based federal judge.
“Were the nationwide injunction (in the Louisiana case) stayed or narrowed, Florida and its citizens would be without protection beginning on December 6,” Moody’s office said in a filing last week.
